1. Acceptance of Terms

By accessing or using The ReelMap platform and services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and The ReelMap, Inc. ("Company," "we," "our," or "us").

2. Description of Services

The ReelMap provides a video-first real estate marketing platform that enables real estate professionals to create, manage, and distribute property videos, lifestyle content, and buyer guides. Videos may be uploaded directly to The ReelMap (hosted on our cloud storage) or embedded from third-party platforms such as YouTube. Our Services include but are not limited to video hosting, embedding, one-click distribution to your connected social accounts (YouTube, Facebook, Instagram), SEO optimization, lead generation tools, analytics, and agent profile pages.

3. Account Registration

To access certain features of our Services, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Our Services may be offered on a subscription basis. By subscribing, you agree to:

  • Pay all fees associated with your chosen subscription plan
  • Automatic renewal of your subscription unless cancelled
  • Provide accurate billing information
  • Pay applicable taxes

Refunds are handled in accordance with our refund policy. We reserve the right to change our pricing at any time, with notice provided to existing subscribers before changes take effect.

5. User Content

You retain ownership of content you upload to our platform ("User Content"). Videos may be added either by uploading directly to The ReelMap, where the file is hosted and delivered through our cloud storage, or by embedding from a third-party platform via a link, where the original host retains and delivers the file. By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, cache, transcode, optimize, and distribute your content — including publishing it to the third-party social accounts you connect, at your direction — solely for the purpose of providing our Services.

You represent and warrant that:

  • You own or have the necessary rights to your User Content, including any music, footage, branding, or likenesses it contains
  • Your content does not infringe on any third-party rights
  • Your content complies with all applicable laws and regulations
  • Your content does not contain harmful, offensive, or illegal material

6. Social Distribution

Our Services include an optional feature that lets you publish your videos to your own third-party social accounts (currently YouTube, Facebook, and Instagram). This feature may be limited to certain subscription plans. When you connect a social account and choose to distribute, you authorize us to securely connect using the third party's authorization (OAuth) process, publish the videos and captions you select, store the access tokens needed to post on your behalf until you disconnect, and retrieve basic publishing status information.

You acknowledge that:

  • Distribution occurs only when you direct it; we do not post without your action
  • Content you distribute is also governed by the terms and policies of each destination platform, which you are responsible for following
  • You have all rights necessary to post the content, including any music, footage, branding, or likenesses it contains
  • We do not control how a third-party platform handles, ranks, moderates, or removes your content once published
  • You may disconnect any social account at any time, which stops future distribution to that account
  • Deleting a video from The ReelMap does not automatically remove copies already published to third-party platforms; you must remove those directly

7. Prohibited Conduct

You agree not to:

  • Use our Services for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our Services
  • Engage in any form of automated data collection without permission
  • Impersonate another person or entity
  • Share false or misleading information

8. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the overall design, are the exclusive property of The ReelMap and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE REELMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless The ReelMap and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of our Services or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
